Major Blow to Bengal Govt! Calcutta HC Refuses to Stay ECI’s IAS-IPS Transfer Orders

In a significant legal victory for the National Election Commission (ECI), the Calcutta High Court has dismissed a petition seeking a stay on the transfer of IAS and IPS officers in West Bengal. The Division Bench of Chief Justice Sujoy Paul and Justice Partha Sarathi Sen ruled on Tuesday that the court would not interfere with the administrative decisions made by the ECI for conducting free and fair elections.

Highlighting 12 key points, the court observed that under Article 324 of the Constitution, the ECI holds extensive powers and is not legally bound to justify every transfer during the election period. The Bench noted that the petitioner failed to prove any collapse in administration or political conspiracy behind the reshuffle of 46 officers. The court emphasized that transfers are a routine part of service, and judicial interference is only warranted in cases of clear illegality. While the PIL was dismissed, the court stated that individual officers could still challenge their transfers independently if they felt personally aggrieved.
