Supreme Court’s historic decision: President has to decide on the bill in 3 months

New Delhi: In an unprecedented decision, the Supreme Court has directed the President to decide within three months on the bills sent by the governors. The decision came on a petition by the Tamil Nadu government, which complained of Governor R.N. Ravi indefinitely holding back several bills. A bench of Justices JB Pardiwala and R. Mahadevan said on Friday, “The President cannot hold back the bill. He has to give assent or suggest amendments.” The decision strengthens constitutional accountability.
Under Article 201 of the Constitution, the President has the right to assent or disapprove of the bill, but there was a lack of time limit. The court clarified that if there is a delay of more than three months, reasons have to be given and it is mandatory to inform the state. Constitutional expert Dr. Anita Sharma said, “This decision will bring transparency in the legislative process and protect the rights of the states.” Conflicts between governors and governments have been common in non-BJP states like Tamil Nadu. The court also gave the states the right to approach the court against the delay. This decision will speed up the democratic process and prevent unnecessary delays.
