Bihar Elections in Supreme Court! Prashant Kishor’s Jan Suraaj Seeks Fresh Polls Over MCC Violation

In a dramatic turn of events, Prashant Kishor’s Jan Suraaj Party has moved the Supreme Court challenging the 2025 Bihar Assembly Election results. The party has sought the nullification of the recent polls and demanded fresh elections in the state. A bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi is likely to hear the plea on Friday.

The Core Allegation: The petition alleges a massive violation of the Model Code of Conduct (MCC) by the Nitish Kumar-led Bihar government. Jan Suraaj claims that after the election schedule was announced, the government illegally transferred ₹10,000 each to over 1.5 crore women under the ‘Mukhyamantri Mahila Rojgar Yojana’, which unduly influenced the voters in favor of the NDA.

Demands Before the Apex Court: Invoking Article 324 of the Constitution and Section 123 of the Representation of the People Act, the Jan Suraaj Party has requested the court to direct the Election Commission to take action against this direct fund transfer. The petition further prays for a permanent guideline that bars the implementation of such welfare schemes at least six months prior to the announcement of elections to ensure a level playing field. In the 2025 polls, the NDA had won a landslide victory with 202 seats, while Jan Suraaj failed to win even a single seat.
