Major Setback in HC! Plea Seeking Stay on IAS-IPS Transfers Dismissed in Bengal

The Calcutta High Court has delivered a significant ruling upholding the Election Commission of India’s (ECI) authority to reshuffle administration ahead of the polls. A Public Interest Litigation (PIL) filed by advocate Arka Kumar Nag, seeking a stay on the transfer of 46 IAS and IPS officers, was dismissed by the court on Tuesday.

The petition challenged the mass transfers executed by the Commission between March 15 and March 19, demanding the immediate reinstatement of the officials to their previous posts. However, the division bench, comprising Chief Justice Sujoy Paul and Justice Parthasarathi Sen, refused to stay the order, effectively validating the Commission’s decision. This legal victory ensures that the administrative structure set by the ECI remains intact as the state moves closer to the election dates.
